Special conditions: Rental of products
Article 1: General provisions
These conditions apply to every order placed by a visitor ("Customer") via the Freya Products webshop. By placing an order, the Customer accepts the applicability of these conditions to the exclusion of all other (own) conditions, unless otherwise agreed in writing in advance.
Article 2: Pricing
All stated prices are in euros, including VAT and statutory taxes. Any delivery or administration costs are stated separately. The price applies solely to the textual description of the article; decorations shown in photos or videos are not included.
Article 3: Offer and assortment
Freya Products strives for a complete and error-free online catalogue, but is only bound by a best-efforts obligation. Obvious mistakes or material errors (such as typographical errors) do not bind Freya Products. The offer is valid while stocks last. For specific questions regarding sizes or delivery times, the Customer must contact us in advance via info@thuiszorgwebshop.be.
Article 4: Online purchases and payment
The Customer selects products and provides correct details for delivery. Payment is possible via Bancontact, Belfius, KBC, PayPal, Visa, iDEAL, bank transfer or deferred payment. Freya Products reserves the right to refuse orders in the event of serious shortcomings by the Customer in previous transactions.
Article 5: Delivery and fulfilment
Delivery takes place within the EU, generally within 5 working days of receipt of the order or payment. If the goods have not been received within this period, the Customer must report this. The risk of loss or damage passes to the Customer as soon as they (or a designated third party) take physical possession of the goods. Visible damage must be reported without delay.
Article 6: Retention of title
Delivered articles remain the exclusive property of Freya Products until the full amount has been paid by the Customer. The Customer may not pledge or encumber the articles as long as ownership has not been transferred.
Article 7: Right of withdrawal and returns
Consumers have the right to withdraw from the agreement within 28 calendar days without giving reasons.
Period: 28 days after physical receipt of the goods.
Return period: The goods must be returned within 30 days of the notification of withdrawal.
Costs: Returns are free for a purchase value above 65 euros. Below this amount, the costs are borne by the Customer.
Condition: Products must be returned in their original condition and packaging. If there is a reduction in value due to use beyond what is necessary to establish the nature of the product, the Customer is liable.
Refund: Freya Products will refund all amounts received within 14 days of receipt of the return or proof of dispatch.
Article 8: Warranty and defects
The statutory warranty of 24 months applies from the date of delivery. Defects must be reported within 2 months of discovery. The warranty does not cover defects caused by accidents, poor maintenance, abnormal use or modifications to the article.
Article 9: Exclusion of right of withdrawal
The right of withdrawal is excluded for:
Custom-made products or products according to the Customer's specifications.
Sealed hygiene products whose seal has been broken (e.g. bandages, braces, intimate articles).
Products with a limited shelf life.
Sealed audio or video recordings whose seal has been broken.
Article 10: Customer service
The customer service can be reached via info@thuiszorgwebshop.be or at the telephone number stated on the webshop. Complaints are handled with respect and we expect the same attitude from our customers.
Article 11: Complaints procedure and mediation
Complaints about the execution of the agreement must be submitted fully described within 7 days of discovery. We will respond within 14 days. If a dispute cannot be resolved mutually, the Customer may turn to Stichting WebwinkelKeur for free mediation or the European ODR platform.
Article 12: Sanctions for non-payment
In the event of late payment, interest of 10% per year is due by operation of law and without prior notice, plus a flat-rate compensation of 10% (minimum 25 euros per invoice). All collection costs are borne by the Customer.
Article 13: Privacy and data protection
Freya Products processes personal data in accordance with legal requirements for order processing and marketing. The Customer has the right of access and correction. Data is not sold to third parties. The Customer is responsible for managing their own login details.
Article 14: Validity and waiver
If a provision is declared void, the remaining provisions remain fully in force. The non-exercise of a right by Freya Products does not constitute a waiver of that right.
Article 15: Amendment of conditions
Freya Products may amend these conditions at any time. Amendments take effect 30 days after announcement for existing agreements.
Article 16: Force majeure
In the event of force majeure (such as internet outages, transport delays or strikes), Freya Products is relieved of its delivery obligation for as long as the situation continues.
Article 17: Intellectual property
All texts, photos and product descriptions on the website remain the property of Freya Products. Copying or publishing without permission is prohibited.
Article 18: Evidence
The Customer accepts that electronic communications and backups serve as full proof in the relationship between both parties.
Article 19: Applicable law and disputes
Belgian law applies. In the event of disputes, the courts of the consumer's place of residence have jurisdiction.
Article 20: Electronic invoicing
Invoicing is done exclusively electronically via e-mail. This also serves as proof of purchase. A paper copy can be provided upon request.
Articles 21 and further: Specific provisions for rental
21. Risk and damage during rental
The renter is responsible for the rented goods. Use is only permitted in Belgium and the Netherlands.
Goods are delivered in perfect condition. Any damage upon receipt must be reported within 24 hours.
Repairs are carried out exclusively by Freya Products. Costs are borne by the renter if the damage was caused by negligence or misuse.
The renter bears the risk for loss or theft and must report this within 24 hours.
22. Rental price and payment
The rental continues on Sundays and public holidays. The rental amount must be paid in advance for the expected rental period.
In the event of non-payment, a late payment interest of 1% per month and a compensation of 15% (minimum 150 euros) is due.
The renter can buy off damage via a premium of 10% of the rental amount (deductible applies).
23. Security deposit The security deposit must be paid before the start of the contract and does not serve as an advance on the rental. Repayment takes place after full settlement of all obligations.
24. Usage guidelines The renter declares to have received the manual and safety instructions and uses the equipment as a prudent person. Daily maintenance is the responsibility of the renter.
25. Termination of rental Freya Products may immediately terminate the rental agreement in the event of non-payment, bankruptcy, seizure or serious misuse of the rented goods.
26. Liability The renter is liable throughout the entire rental period for all damage or nuisance that the rented goods cause to third parties or to themselves.
